A Canadian couple in Canada who used a Viagra-like drug to treat erectile dysfunction, a federal jury in Canada, found them guilty of federal crimes for selling the erectile dysfunction drug Viagra in the same manner that men in the U. S. were charged with.
The federal judge ordered the government to pay $3.8 million to the Canadian government, which would have been more than $2.4 million more than what was agreed at the plea agreement.
The case was heard in the Superior Court of Alberta in the western U. S., in B. C. in Canada, and in the U. District Court for the District of Alberta in Alberta. Both courts found that the defendants were guilty of all charges of the crime of “offering” Viagra to men in the U. and in Canada. The government did not admit that the defendants had any intent to use Viagra to induce them to have sex.
The trial took place in early November, and jury instructions were given on the defendants' guilt.
The defendant, Robert T. Bouschetti, said that he had used Viagra and a prescription medication to treat his erectile dysfunction for about two decades before taking the pills to make up his mind.
“I didn’t use it because I didn’t know how to use it.”
Bouschetti, who was 20 years old at the time of his arrest, was taking Viagra for erectile dysfunction. His lawyer argued that the pill “significantly increased the risk of sexual problems with a man who is not sexually aroused.”
Bouschetti said he would pay $100,000 a year for Viagra, plus a $5,000 settlement in his case.
“The jury returned a guilty verdict,” Bouschetti told the trial court. “They had the evidence they had.”
The court also found that Bouschetti had violated several federal laws, including the federal Food, Drug, and Cosmetic Act. The government was ordered to pay $1.8 million, which would have been about $2.4 million more than what the government agreed at the plea agreement.
Bouschetti will continue to pay the full cost of his sentence.
He has previously faced three felony charges for the drug. Bouschetti had pleaded guilty to the same charges in the first two cases. The government is trying to recover a $8 million fine.
In the first case, Bouschetti admitted that he and three other men were sexually abusing the pills, which he took to treat his erectile dysfunction.
Bouschetti also had a prescription for the drug in Canada, which he took in 2010. Bouschetti had been prescribed Viagra and a prescription in the U. since he was 20 years old.
In the second case, Bouschetti admitted that he and three other men were using Viagra and a prescription medication to treat their erectile dysfunction. He admitted that he had used the drugs himself, and was also taking a prescription medication to treat his erectile dysfunction.
Bouschetti also admitted to a second misdemeanor charge of having a sex within the meaning of a criminal statute, which was a violation of the Federalemen of the U. and Canada Statutes.
“The fact that a man is under a criminal conviction does not automatically mean that he will have the drugs he was taking,” said Bouschetti. “It is not an inevitable consequence of taking a drug or a drug that makes you sexually aroused.”
Bouschetti has not yet reached the trial for his co-defendants.
